I need the detailed Legal opinion on the following issue: under the delivery contract Texas company has delivered to foreign company (the Buyer) the equipment. The Buyer decided to return the equipment and not to pay. I need the detailed conclusion basing on definite points of Texas law, under which the Seller undertakes to mitigate the losses, namely: to accept the delivered equipment in order to mitigate the losses. The equipment to be returned is absolutely new and has not been used.
